Tailored Fee Agreements (TFA)
The invoicing system at Lineros & Cia., as that of most law Firms involved in the area of IP matters, is built upon the basis of pre-fixed services fees, where a certain fee is assigned to a specific service according to its nature previously determined and categorized. This is usually not applicable to those services consisting of legal representations and consultancy services whose complexity and estimated length are assessed beforehand, and which are regularly charged upon the basis of hourly billing. Our full schedules of fees for all our services, as well as the specification of those matters that are billed over hourly basis, are available prior written communication with all your identification data.
Besides the above, the Firm has developed and strongly promotes among its clients the execution of Tailored Fee Agreements (TFA), by means of which clients do benefit of both special fees and particular conditions to perform the work they entrust us. These agreements between Lineros & Cia. and the client, which are kept in strict confidentiality, provide compensation to Lineros & Cia. based on a structure other than standard fixed fees and hourly billing. Such structures depend on the alternatives available according to the nature and characteristics of the work or service to be retained, being possible to choose among the following:
1. Specific project arrangements
Open to clients interested in retaining the services of Lineros & Cia. in the areas of filing and administrative prosecution -excluding consultancy and judicial representation-, aiming to perform specific projects that encompass a relevant number of issues. Through this kind of TFA it is possible for the client to benefit from special reduced fees and from the arrangement of customized payment terms.
2. Long term assistance arrangements
Addressed to clients willing to establish with Lineros & Cia. a long term business relationship that encompass any kind of services, but excluding complex consultancy services and judicial representation. As result of these agreements the client benefits from receiving a permanent, immediate and privileged support as soon as the service is requested, reduced services fees and the execution of some complementary services free of charge. This kind of TFA is concluded with the client upon the basis of a comprehensive understanding that encompasses a group of selected areas of practice, an estimated assessment of work volume and a pre-fixed monthly fee.
3. Pure or partial contingency fee arrangements
These TFA are designed for judicial litigation matters involving a risk of gain or loose and whose prosecution usually requires from the client the investment of considerable amounts in service fees and expenses, as well as the need to wait certain timeframe before the outcome arises. In order to face these drawbacks that in some cases might discourage clients from engaging in litigation issues, Lineros & Cia. has developed and is permanently open to negotiate these agreements, seeking through this way to combine different criteria to reach a balanced risk-sharing fee structure that eventually facilitates the decision of the client to pursue some matter, along with guaranteeing a reasonable retribution to the Firm for the services rendered and the risks undertaken.
Among the alternatives available of these kind of agreements are the following:
- Based on a pure contingency fee
- Based on a partial contingency fee plus an initial payment
- Based on a partial contingency fee plus a monthly payment.
